General information only
Everything published on this website (including blog posts, practice-area pages, FAQs, and any downloadable material) is general legal information published for educational purposes. It explains how the law usually works in Queensland and Australia. It does not, and cannot, take into account the particular facts of your matter, your jurisdiction, or how a court is likely to apply the law in your circumstances.
Information vs legal advice
Nothing on this site is legal advice. Legal advice involves applying the law to specific facts, advising on a course of action, and accepting professional responsibility for that advice. We provide legal advice only after:
- we have run a conflict check and confirmed we can act for you;
- we have provided a written costs disclosure under section 308 of the Legal Profession Act 2007 (Qld); and
- you have engaged us under a costs agreement.
Until those steps are complete, no information you read on the site, no enquiry you send through a contact form, and no email or phone call gives rise to legal advice or a solicitor-client relationship.
Currency of information
We make reasonable efforts to keep content current, but the law changes and the position may have moved since a page was published. Where the date matters, we publish a date alongside the content. Where a statute has been replaced (for example, the Property Law Act 2023 (Qld) replacing the Property Law Act 1974 from 1 August 2025), older articles may not reflect the current position. The most recent version of any Queensland statute is published on the Queensland Legislation website at legislation.qld.gov.au.
Statute references
References to legislation on the site (for example, "section 79 of the Family Law Act 1975 (Cth)") are provided for general orientation. We italicise the title of the Act and put the jurisdiction in plain text after it. Section numbers refer to the Act as in force at the date of publication. Always check the current version of the Act before relying on a section reference.
Third-party content and links
The site may include links to third-party websites, including government registers, courts, professional bodies, and reported decisions. We provide those links for convenience. We are not responsible for the content, accuracy, or availability of any third-party site. Inclusion of a link is not an endorsement.
Quotations from cases, statutes or third-party publications are reproduced under fair dealing for the purpose of criticism, review, or news reporting under the Copyright Act 1968 (Cth), or with permission. Where a third party owns the copyright in a quotation, that ownership is acknowledged in the source.
Reliance and outcomes
We do not promise any particular outcome from any matter. Legal outcomes depend on facts, evidence, court discretion, and many factors outside the control of any lawyer. Statements on the site about how matters typically run, what statutes typically require, or what a court is likely to do are general observations, not predictions for your matter.
If you act, or refrain from acting, on the basis of information from this site without obtaining advice tailored to your matter, you do so at your own risk.
Liability and Professional Standards
To the maximum extent permitted by law, we exclude all liability for loss or damage of any kind (including consequential loss) arising from your use of, or reliance on, this site or any content on it.
Liability for legal services we provide in the course of acting on a matter is limited by a scheme approved under Professional Standards Legislation. The scheme is administered by the Professional Standards Council. Information about the scheme and the limits is available at psc.gov.au.
If you need advice
If a topic on this site relates to a matter you are dealing with, the next step is to talk to us, or to another lawyer who acts in that area. Information you find online is a starting point, not a substitute for advice on your facts.
