About Fraser Lawyers
Fraser Lawyers is a Gold Coast law firm in Bundall, principal Blake Fraser, established in 2013. The firm is regulated by the Queensland Law Society and operates under the Legal Profession Act 2007 (Qld) and the Australian Solicitors' Conduct Rules.
In these terms, "we", "us" and "our" refer to Fraser Lawyers. "You" and "your" refer to any person who accesses or uses the site. The "site" means everything published at www.fraserlawyers.com and any related subdomains.
Information, not advice
The content on the site, including blog articles, practice-area pages and FAQs, is general legal information published for educational purposes. It is not legal advice and must not be relied on as legal advice for any particular matter.
Legal advice depends on the specific facts of your matter, the law as it applies in your jurisdiction, and how a court is likely to apply that law in the circumstances. None of those things can be assessed from a webpage. The only way to obtain legal advice from us is to engage us under a written costs agreement.
The site refers to legislation that is current at the date of publication. Statutes are amended from time to time and the position may have changed since publication. Where the date of an article matters, we publish a date alongside the content.
No solicitor-client relationship
Reading the site, sending an enquiry through a contact form, calling the firm, or sending an email does not create a solicitor-client relationship between you and Fraser Lawyers. A relationship is created only when:
- we have run a conflict check and confirmed we can act for you;
- we have provided a written costs disclosure under section 308 of the Legal Profession Act 2007 (Qld); and
- you have signed a costs agreement, or otherwise instructed us to commence work, after receiving the costs disclosure.
Until those steps are complete, no information you send us is treated as confidential in the way client communications are. Please do not send sensitive material to us before we have confirmed we can act.
Intellectual property
All content on the site (including text, layout, design, logos, photographs, graphics and code) is owned by Fraser Lawyers or used under licence. It is protected by Australian copyright, trade mark and other intellectual property laws.
You may view content for personal, non-commercial use. You may print or download single copies for that purpose. You may not copy, reproduce, republish, distribute, modify or commercially exploit any content without our prior written consent.
The "Fraser Lawyers" name, logo and visual identity are trade marks of Fraser Lawyers. Use of the name or logo, including in advertising, comparison articles, or for any commercial purpose, requires our written permission.
Linking and third-party sites
You may link to the homepage of the site. Deep links to specific articles or pages are also permitted, provided the link does not suggest endorsement, partnership or affiliation that does not exist, and does not frame the page as part of another site.
The site may include links to third-party websites. We provide those links for convenience only. We do not endorse and are not responsible for the content, products, services or privacy practices of any third-party site.
Forms and submissions
If you send us material through a website form, by email, or by phone, the way we handle that material is set out in our Privacy Policy. We do not treat material sent through public-facing forms as legally privileged unless and until a solicitor-client relationship is in place.
Do not send material through the site that is unlawful, defamatory, infringing of someone else's rights, or that you do not have the right to send. We may delete material that does not comply.
Liability and disclaimers
The site is provided on an "as is" basis. We make reasonable efforts to keep content accurate and up to date but make no warranty that the content is current, complete or fit for any particular purpose.
To the maximum extent permitted by law, we exclude all liability for loss or damage of any kind (including consequential loss) arising from your use of, or reliance on, the site or any content on it. Where we cannot lawfully exclude liability, our liability is limited to (at our option) re-supplying the content or paying the cost of having the content re-supplied.
Our liability for legal services provided in the course of acting on a matter is governed by our written costs agreement and is limited by a scheme approved under Professional Standards Legislation. Liability under that scheme is limited as set out at psc.gov.au.
Privacy
Information you provide through the site is handled in accordance with the Privacy Act 1988 (Cth), the Australian Privacy Principles, and our Privacy Policy. By using the site you acknowledge that you have read and understood the Privacy Policy.
Changes to these terms
We may update these terms from time to time. The "last updated" date at the top of the page reflects the most recent version. Material changes will be flagged at the top of the page for at least 30 days. Continued use of the site after a change is taken to be acceptance of the updated terms.
Governing law
These terms, and any matter arising under them, are governed by the law of Queensland. You and we submit to the exclusive jurisdiction of the courts of Queensland.
